Average Herniated Disc Car Accident Settlements in New Jersey

When you suffer life-changing neck and back injuries in a rear-end accident, you often face an uphill battle getting the compensation you deserve.  We have recovered more than $30,000,000 for accident victims since our firm opened in 1994. If an accident left you with a herniated disc, years of shooting pain and incapacitating weakness could be in your future. Your physical well-being and your lifestyle may never be the same.  We wanted to put together some example payouts and settlements we have seen with New Jersey cases so you can get an idea of what the average herniated disc settlement looks like.

According to the herniated disc accident settlement examples listed on this page, the typical New Jersey herniated disc accident settlement is anywhere from $117,000 to $750,000. Settlements depend greatly on the unique circumstances of each case which is why we will never promise that you can receive a certain amount because there are multiple factors that go into developing a case. Even when we do propose an amount, we will likely receive a counter-offer from the insurance company and work to negotiate it.

  1.  $117,000 Payout for Multiple Herniated Discs

Over a three-day trial in Somerset County, the jury heard the case in its entirety. During the trial, the insurance adjuster from NJM never once left the courtroom. On day one, NJM offered to settle for just $25,000 – for less than Robinson deserved. On day two, the insurer upped its offer to $50,000. Knowing that accepting such a settlement would hardly cover her unpaid medical expenses, lost wages, and the costs of pursuing the claim and bringing it to trial, she chose to let the jury decide the case. In the end, the jury awarded her $20,000 compensation for her lost income and her unpaid medical expenses, along with $90,000 for the pain and suffering she went through because of the collision. With pre-judgment interest, the final jury award was more than $117,000. Though her life will never be the same as it was before the accident, she won’t have to worry every day that the actions of one careless driver will lead to financial disaster.

    Rear-Ended Herniated Disc Settlement

On the morning of the 2009 collision, Julie Robinson was driving on Route 182 in Hackettstown, NJ. She stopped at a red traffic light. The car behind her didn’t stop – instead; it collided with her stopped vehicle. Robinson, 39, suffered a lumbar disc herniation and multiple herniated discs in the cervical region of her spine. To this day, she continues to need ongoing medical treatment for her back injuries, and doctors have recommended spinal surgery. She also missed months of work, costing her thousands of dollars in lost wages.  The odds may not have been in our client’s favor, but with our firm on her side and our own New Jersey car accident attorney Michael E. Ellery leading the fight for her rights, she got the six-figure payout she deserved.  The at-fault driver’s insurance company, New Jersey Manufacturers (NJM), is known for being a difficult insurer to settle these types of cases voluntarily. Our client’s case was subject to New Jersey’s verbal threshold, meaning that she would have to prove she had sustained serious a permanent injury as a result of the accident. The case went to trial in Somerset County, an extremely conservative county where a plaintiff hadn’t won a similar case in two and a half years.  Despite the severity of Robinson’s injuries, NJM refused to offer her the settlement she deserved. The vehicles involved in the crash weren’t heavily damaged, a point which NJM tried to use against the victim. NJM also tried to argue that Robinson’s neck and back injuries were degenerative, even though she had never complained of back problems before the accident. The case went to arbitration, but NJM quickly appealed the arbitration award. That’s when we took the case to court.Over a three-day trial in Somerset County, the jury heard the case in its entirety. 2.  $125,000 Settlement for a Herniated Disc from a Car Crash

Near the end of an hour-long trip from Absecon, New Jersey, to Chester, Pennsylvania, an auto accident changed our client’s life forever. She was the passenger in the car her husband was driving on Edgmont Avenue, near the 14th Street intersection. Suddenly, another vehicle ran the stop sign on 14th street and collided with the couple’s car.  An ambulance rushed our client to nearby Crozer Chester Medical Center in what becomes the start of a years-long series of medical tests and treatments, at times interrupted because her insurance company denied her the medical benefits she needed. She had sustained numerous injuries, including damage to the chest, ribs, shoulders, and multiple regions of the spine. She also suffered a concussion. Though each of her injuries was serious, the most severe turned out to be a herniated disc in the cervical region of her spine and thoracic outlet syndrome, a condition in which nerves in the neck become compressed, causing arm, neck, and shoulder pain. Ultimately, this client had to undergo multiple surgical procedures, including discectomy surgery and thoracic outlet syndrome surgery.  As a result of this accident, our client suffered years of acute, chronic pain, and emotional distress. Even after the numerous surgeries, she continued to experience persistent discomfort, which her doctors expect to be permanent. Our New Jersey car accident attorneys fought to get her $125,000 – compensation that we knew she fully deserved after all she had been through.

What began as just another day at work ultimately changed the life of our client, a tractor-trailer driver who wasn’t even moving at the time of the accident. Our client had pulled over on the side of the road for a break when the driver of a second tractor-trailer lost control of his vehicle and struck our client. Truck drivers are subject to strict labor laws intended to prevent them from driving while overtired. The law required our client to take a break to sleep, so when he reached an area that designated as a rest stop for truck parking, he pulled over to the side of the road to join a line of other parked tractor-trailers. Our client was asleep in his bunk in the truck’s cab when a sudden impact from the rear of the truck woke him and threw him from his bunk. The crash had split the trailer in two and pushed the truck into the tractor-trailer in front of it, but even worse was what the collision did to our client’s health. His neck hit the stick shift, and then the floor. He had multiple herniated discs at points in both the cervical and lumbar regions of his spine. He developed wrist injuries in both arms, including carpal tunnel syndrome in the left wrist. Our client was forced to undergo not one but two surgeries, and would likely continue to experience pain on an ongoing basis, possibly for the rest of his life. He also missed work and lost his job. His quality of life had been forever compromised. Even years later, he has difficulty lifting weights and riding a bike. He can no longer pick up his grandchildren like he once could.Through our determination and diligence, our New Jersey truck accident attorneys were able to recover $750,000 on behalf of our client. Though nothing can give him back his health, the compensation will repay his family for the damages such as his lost income and medical expenses and make it easier for him to cope with and get treatment for his painful injuries.Copy of Recent Herniated Disc Car Accident Lawsuit Settlements in NJ
  2. $200,000 Herniated Disc Car Accident Lawsuit Settlement
Struck from behind while stopped for traffic, our client immediately experienced pain in his neck as a result of being rear-ended. He was able to drive to the emergency room where doctors prescribed him medication for his pain and advised him to follow up with an orthopedic surgeon because our client was injured during while on the job‚ he initially went through the worker’s compensation claim process to schedule his medical appointments‚ which took time. As he waited to see a surgeon about his neck‚ the pain worsened and began to radiate throughout his limbs. An MRI of his spine revealed a disc herniation in his spine, pressing on the surrounding nerves. The nerve impingement also caused muscle tissue in his shoulder to deteriorate to the point that it was easily apparent with the naked eye. After several months of unsuccessful physical therapy, he was facing invasive surgery as the only option left to reduce his constant pain. Staring a life-changing amount of medical debt in the face, he knew he needed legal help to hold the driver responsible for his injuries accountable for their thoughtless actions. Our New Jersey car accident attorneys immediately helped him find expert medical doctors to review his injuries and perform new diagnostic tests. These medical experts settled on a targeted spinal fusion surgery to repair our client’s herniated disc and restore functionality to his upper limbs. Doctors credit this procedure as the catalyst for our client’s subsequent recovery. While our client still experiences some neck and back pain, it’s nowhere near the debilitating level he experienced before we took charge of his personal injury claim. The back injury settlement we obtained from the at-fault driver’s insurance company‚ $200‚000‚ allowed our client to come out of his ordeal without any medical debt and with the deserved compensation needed to return to as much of his life before the accident as possible.
